Someone enters their email, then receives a confirmation email with a link, and only becomes a real subscriber once they click it. Single opt-in skips the second step. The person is on your list the moment they submit the form.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7926f83 elementor-widget__width-inherit elementor-widget-tablet__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"7926f83\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The difference sounds small. In practice it decides who ends up on your list. With single opt-in you get everyone, including typos, fake addresses, and people who signed up someone else. With double opt-in you get only the addresses that exist and belong to someone who wanted in.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5f6cbdb elementor-widget__width-inherit elementor-widget-tablet__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"5f6cbdb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t\ud83d\udca1 <strong style=\"color: #8b5cf6;\">Tip <\/strong>The confirmation email is not marketing. It confirms an address. Keep it to one line and one button. The moment you add a product or an offer to it, you have turned a permission step into an ad, and in Germany that is a problem I will come back to.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-1ae2009 e-con-full e-flex e-con e-child\" data-id=\"1ae2009\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-8e1935b toc-title elementor-widget elementor-widget-heading\" data-id=\"8e1935b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<div class=\"elementor-heading-title elementor-size-default\"><div class=\"h2-style\">What Swiss law says<\/div><\/div>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c72df85 elementor-widget__width-inherit elementor-widget-tablet__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"c72df85\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Here is the part most English-language articles get wrong, because they write for a GDPR audience and assume Switzerland works the same way. It does not.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-76be743 elementor-widget__width-inherit elementor-widget-tablet__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"76be743\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Two Swiss laws matter for email. The first is the UWG, Switzerland&#8217;s Unfair Competition Act. Article 3 paragraph 1 letter o says mass advertising email needs prior consent, a real sender, and a working unsubscribe in every message. It does not say the consent has to be a clicked confirmation email. A checked box on a form is consent under the UWG.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-49f9918 elementor-widget__width-inherit elementor-widget-tablet__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"49f9918\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The second is the revised Swiss data protection act (revDSG), in force since September 2023. It governs how you store and handle the personal data, and it expects you to be able to show that consent was given. It also does not require double opt-in by name.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-cefca21 e-con-full e-flex e-con e-child\" data-id=\"cefca21\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-7916bed elementor-widget__width-inherit elementor-widget-tablet__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"7916bed\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>\u00a0\ud83c\udde8\ud83c\udded <strong style=\"color: #2663eb;\">Swiss rule <\/strong>Under the UWG, single opt-in is legal for a Swiss shop mailing Swiss subscribers. You need consent, a real sender and an unsubscribe link. You do not need a confirmation email.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a21d006 elementor-widget__width-inherit elementor-widget-tablet__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"a21d006\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>So if the law is the only thing you care about, and you sell only inside Switzerland, you can run single opt-in and stay on the right side of it. I still would not, and the reason is in the last two sections.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-b2ac918 e-con-full e-flex e-con e-child\" data-id=\"b2ac918\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-12bb595 toc-title elementor-widget elementor-widget-heading\" data-id=\"12bb595\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<div class=\"elementor-heading-title elementor-size-default\"><div class=\"h2-style\">The line that moves the moment you email Germany<\/div><\/div>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a18f7e9 elementor-widget__width-inherit elementor-widget-tablet__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"a18f7e9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Most Swiss shops do not sell only inside Switzerland. The day you take an order from Germany or Austria, and put that person on your list, the GDPR applies to that contact. Now the rules are different.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2ff5141 elementor-widget__width-inherit elementor-widget-tablet__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"2ff5141\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The GDPR does not use the words double opt-in either. What it requires is that you can prove consent was freely given, specific and informed. That is where the confirmation email earns its place. German courts have treated the double opt-in click as the clean way to prove someone asked to be there. Without it, the burden of proving consent sits on you, and a form submission you cannot tie to a real person is weak proof.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-05b2d84 elementor-widget__width-inherit elementor-widget-tablet__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"05b2d84\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>\ud83c\udde9\ud83c\uddea <strong style=\"color: #2663eb;\">German<\/strong> rule German case law points to double opt-in as the practical way to prove consent. But the confirmation email itself must contain no advertising. A confirmation email that also promotes a product has been treated as an unsolicited ad in its own right.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c018988 elementor-widget__width-inherit elementor-widget-tablet__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"c018988\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>That last point catches people. They add double opt-in, then put a 10% welcome code in the confirmation email to soften the extra step. In Germany that turns the compliance step into the exact thing it was meant to protect against. Keep the confirmation email empty of any offer. Put the code in the welcome email that comes after the click.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f11f775 elementor-widget__width-inherit elementor-widget-tablet__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"f11f775\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t\u26a0\ufe0f\u00a0<strong style=\"color: #ffa018;\">Watch out <\/strong> If you ship to Germany or Austria, treat double opt-in as effectively required and keep the confirmation email advertising-free. The cost of getting this wrong is not a warning email, it is a formal cease-and-desist letter, which in Germany carries real fees.\n\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-b6a48e5 e-con-full e-flex e-con e-child\" data-id=\"b6a48e5\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-ae40546 toc-title elementor-widget elementor-widget-heading\" data-id=\"ae40546\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<div class=\"elementor-heading-title elementor-size-default\"><div class=\"h2-style\">The deliverability case, separate from the law<\/div><\/div>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2632327 elementor-widget__width-inherit elementor-widget-tablet__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"2632327\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Put the law aside for a moment. Even if you sell only inside Switzerland and never touch a German address, I would still turn double opt-in on, because of what it does to your inbox placement.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-adcc67b elementor-widget__width-inherit elementor-widget-tablet__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"adcc67b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Single opt-in lets three things onto your list that quietly damage it. Typo addresses that hard bounce. Spam-trap addresses that some people paste into forms. And angry signups, where someone enters a rival&#8217;s address or a public one as a joke. Every one of those hurts the signals Gmail and Microsoft use to decide whether you reach the inbox.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fa323b1 elementor-widget__width-inherit elementor-widget-tablet__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"fa323b1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Since early 2024, the mailbox providers have been much stricter about this. A list that grows through single opt-in tends to carry a higher bounce rate and more spam complaints, and both push more of your mail to the spam folder, including the mail your real subscribers wanted.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8df6d55 elementor-widget__width-inherit elementor-widget-tablet__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"8df6d55\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t\ud83d\udcca <strong style=\"color: #8b5cf6;\"> Quick fact <\/strong> Gmail and Yahoo now expect bulk senders to keep spam complaint rates under 0.3% [1]. A single opt-in form with no protection is one of the fastest ways to cross that line, because you cannot control who types what.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-09af3b2 elementor-widget__width-inherit elementor-widget-tablet__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"09af3b2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Double opt-in is the cheapest filter for all of it. The typo never confirms. The trap rarely clicks. The joke signup does not bother. What lands on your list is a set of addresses that exist and belong to someone who wanted your email. That list reaches the inbox, and it keeps reaching it.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cf1ce3a elementor-widget__width-inherit elementor-widget-tablet__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"cf1ce3a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t\u270b <strong style=\"color: #8b5cf6;\"> My honest opinion  <\/strong> I have watched shops obsess over the small drop in signups that double opt-in causes, while ignoring that the people who do not confirm were never going to buy. A slightly shorter list of real, engaged addresses beats a longer list that drags your whole sender reputation down.
